Criminals Lose Ability to Sue for Injuries Sustained During Crime

State Capitol, Phoenix People committing crimes lose the ability to sue their victims if they are injured during their illegal activity, under a bill approved by the House last week. HB2813, sponsored by Rep. John Kavanagh, states that if a criminal's action was partly responsible for any injury or harm, a judge or jury may not award monetary damages in a lawsuit if the criminal is at least 50 percent responsible for the event that caused harm. "Criminals should not have the right to sue for damages that arise out of their criminal activity, nor should they be allowed to somehow profit from their crimes," Kavanagh, R-Fountain Hills, said. "Criminals should be in court to be sentenced not to fleece their victims with frivolous lawsuits." HB2813 now heads to the Senate for consideration.
