Three Members of Drug Organization Sentenced to 15 Years

Baltimore, Maryland U.S. District Judge Richard D. Bennett sentenced three Baltimore men who were members of a drug distribution organization to 15 years in prison, for conspiring to participate in the activities of a racketeering enterprise, specifically, the drug organization. Marvin Jackson, age 45, was sentenced today to 15 years in prison, followed by 10 years of supervised release. Derick Fallin, age 51,was sentenced on August 20, 2012, and Johnnie Davis, age 42, was sentenced on August 14, 2012, each followed by five years of supervised release. Fallin and Davis also pleaded guilty to conspiracy to commit murder in aid of racketeering. According to their plea agreements, Fallin and Jackson conspired to distribute drugs for over 15 years. Fallin and Jackson began distributing heroin in the mid-1990's; began distributing marijuana together in around 2000, along with Johnnie Davis; and began distributing cocaine with Davis and others in 2005. Over the course of the conspiracy Jackson and Fallin obtained their drugs from different sources, including sources of supply in New York and Atlanta, typically receiving about 500 pounds of marijuana at a time. Near the end of the conspiracy, Jackson and Fallin obtained their drugs primarily from the Southwest. The drugs would be shipped into Maryland by mail or through ground transport. Fallin and Jackson used other members of the conspiracy, including Johnnie Davis, to distribute the drugs to the organization's customers, then bring the money back to the organization. Much of the cash was kept in stash houses throughout Baltimore. In 2008, two individuals stole $250,000 from one of the stash houses. After learning the identity of the robbers, Fallin entered into a conspiracy to murder them, initially for $10,000 and gradually increasing the bounty over time. Davis conspired with Fallin to look for and kill the robbers, but they were ultimately unsuccessful. Over the course of the conspiracy, Fallin, Jackson and Davis were arrested in possession of narcotics on several occasions. For example, on July 12, 2006, Fallin, Jackson and Davis were arrested in possession of 66 pounds of marijuana and a shotgun; on June 22, 2007, Jackson and Davis were arrested in possession of three pounds of marijuana; and on February 19, 2010, Fallin and other conspirators were arrested in possession of 31 pounds of marijuana. Fallin, Jackson and Davis admit that they were responsible for the distribution of between 6,600 and 22,000 pounds of marijuana. Four additional defendants charged in the case pleaded guilty to the conspiracy, and three of those were sentenced to between six and 8 ½ years in prison. The remaining defendant is awaiting sentencing.
