Former Attorney General Grant Woods Joins Anti-Prop 201 Effort

Says 201 Will Move Arizona Away from Mediation to Litigation PHOENIX Former Arizona Attorney General Grant Woods has joined 'Arizonans Against Lawsuit Abuse,' the campaign to defeat Prop 201. "Arizona needs to promote more mediation and arbitration when it comes to contractual disputes," said Woods. "Prop 201 does just the opposite; it replaces our current fair and equitable mediation system with a litigation-based scheme that will be costly and time-consuming for new homeowners. We already have enough lawsuit abuse in this state. We don't need more laws on the books designed to promote frivolous lawsuits." Woods was Arizona's Attorney General from 1991-1999. During his time in office, he led his fellow Attorneys General in their national, successful landmark effort against Big Tobacco. "Like Big Tobacco, the out of state big labor supporters of Prop 201 think they can pull one over on the citizens of this state and go unchallenged," Woods continued. "I challenged and exposed Big Tobacco and won. I now challenge Prop 201 and we will expose the real effect it will have on Arizona consumers." According to Woods, Prop 201 will nullify Arizona's landmark 'Opportunity to Repair Law,' and replace it with a litigation-based laws to settle disputes between contractors and new home buyers. Arizona's current 'Opportunity to Repair Law,' (A.R.S. 12-1361 1366): · Allows for new homeowners to get their problems fixed within 90 days; · Encourages parties to come to agreement and avoid costly litigation where usually only lawyers win; · And in the event that mediation is not successful, homeowners can then pursue litigation. "Our current laws on the books make sense," stated Woods. "Why would we cast them aside? I am confident that the voters will see through this misnamed and 'feel good' proposition by just saying 'no.'"
