PHOENIX - Victoria Flockhart, 64, of Chandler, Arizona, has been found guilty of Leaving the Scene of a Fatal Accident by a federal jury in Phoenix. The case was tried before United States District Court Judge James A. Teilborg. Sentencing is set before Judge Teilborg on November 17, 2010.
Evidence at trial showed that on March 21, 2007, at about 1:30 a.m., Flockhart, drove a vehicle that struck and killed the 34 year-old Native American victim as the victim attempted to cross East McKellips Road, near the North Dobson Road intersection, on the Salt River Pima-Maricopa Indian Reservation. Flockhart failed to stop at the accident scene as required by law.
A conviction for Leaving the Scene of a Fatal Accident carries a maximum penalty of 8.75 years, a $250,000 fine or both. In determining an actual sentence, Judge Teilborg will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.
The investigation leading to the guilty verdict was conducted by the Salt River Police Department.
